What searches should be carried out on a residential purchase?
Local authority searches reveal planning, road, and enforcement history. Water and drainage searches confirm connections and nearby infrastructure. Environmental searches flag flood risk, contamination, and ground stability. Additional searches (coal mining, chancel repair, energy infrastructure) are required depending on location. We advise on which searches are needed for your specific property.
What is a boundary dispute and how are they resolved?
Boundary disputes arise where neighbours disagree about the precise location of the legal boundary between their properties. The legal boundary is determined by the title deeds and any plan attached. Resolution options include direct negotiation, formal mediation, application to the Land Registry, and court proceedings. Early, evidence-based legal advice substantially increases the chance of resolution without litigation.
What is adverse possession?
Adverse possession (sometimes called squatter's rights) allows a person who has been in factual and exclusive possession of land for a sufficient period to apply to be registered as the owner. The period is generally 10 years for registered land. The application is opposed by the registered owner as a matter of course. We have successfully completed multiple adverse possession applications including contested ones.
What is a section 21 notice and is it still valid?
A section 21 notice is the mechanism by which landlords seek possession of assured shorthold tenancies without a specific ground. The Renters' Rights Bill, currently before Parliament, proposes to abolish section 21. We recommend all landlords take current advice on their possession strategy given the rapidly changing legislative position.
